Oklahoma Medical Marijuanas Laws in 2024

Oklahoma was quick to join the bandwagon in criminalizing cannabis back in 1933. It would not be until 2015 that there would be any shift in marijuana law in the state. That was when Governor Mary Fallin signed House Bill 2154 into law, also known as Katie and Cayman’s Law. This legalized the prescription of CBD oil to minors suffering from severe epilepsy.

In 2016, House Bill 2835 was passed which expanded the list of medical conditions beyond just epilepsy and opened up the age restrictions to adults. In this same year, a petition was made to push for medical marijuana legalization.

Due to legal issues over the verbage and allegations Attorney General Scott Pruitt made changes to the language, the referendum had to be reviewed by the Supreme Court before finally being added to the ballot in 2018. Despite the process beginning in 2016 voters would not see State Question 788 on the ballot until 2018.

When it was passed into law, it established the rules and regulations governing medical marijuana including establishing licenses for dispensaries.

In March of 2019, Governor Kevin Stit signed House Bill 2612 into law. The Oklahoma Medical Marijuana and Patient Protection Act or “Unit” Bill,” established some employment and firearm ownership protections to medical patients. It also established some legal changes to drug testing. It also authorized the formation of the OMMA.

In 2022, HB 3208 was passed delaying the state accepting any new applications for grower, processor, and dispensary licenses until August 26, 2022. 2023’s HB 2095 further extended that date to August 1, 2026. This means there’s currently a cap on who can enter the cannabis space.

Regarding recreational cannabis, Oklahoma State Question 820 was on the ballot of a special election on March 7, 2023 and would have legalized recreational cannabis. This would have placed the new industry under the oversight of the OMMA. It failed by a vote of 61% voters deciding against legalizing cannabis.

  • Up to 3 ounces on your person.
  • Up to 8 ounces in your home.

  • Up to 6 mature plants for personal cultivation.
  • Up to 6 seedling plants.

How To Get A Medical Card In Oklahoma If Out-Of-State:

Residents of other states with state-government-issued medical marijuana cards or recommendations are eligible for a 30-day adult or minor out-of-state patient license. You cannot use an out-of-state card at a dispensary you will need to officially apply for an Oklahoma out-of-state license.

You will need an official license. For example, patients from Missouri and Arkansas are eligible because those states issue licenses but Texas does not.

To fill out an out-of-state application you must provide your state-issued medical marijuana patient license, a photo and proof of identity. You can use digital color copies of the front and back of a state-issued driver license or ID card, or a U.S. Passport.

The nonrefundable out-of-state patient license processing fee is $100, plus a $4.30 credit card processing fee.

How Much Does A Medical Marijuanas Card Cost In Oklahoma?

The standard application fee is $100. Patients who provide acceptable proof of Medicaid (SoonerSelect) or Medicare enrollment or status as a 100% disabled veteran can pay a reduced fee of $20. Application fees must be paid by Visa, MasterCard, or Discover credit or debit card.

However, Oklahoma is an at-will state so employers can fire employees for using cannabis on the job or being intoxicated while working. Also, some state and federal employees are not eligible to have their position if they’re using medical marijuana because it remains federally illegal.

This law also protects medical marijuana rights as students, in housing and with retaining their right to carry a gun.
