Maryland Medical Marijuana Laws in 2025
Maryland has consistently been at the forefront of decriminalization. While decriminalization is not legalization, this attitude does serve residents seeking the valuable benefits of medical cannabis. In 1987, Kurt Schmoke the first black mayor of Baltimore was outspoken against the War on Drugs and argued for decriminalization.
In May of 2003, Governor Bob Ehrlich signed a bill instituting a maximum fine of $100 for people using cannabis for pain relief. This was the first step in a movement towards medical marijuana legalization.
In June 2014, Governor Martin O’Malley signed HB881 into law, which legalized medical cannabis and established the Maryland Medical Cannabis Commission (MMCC) to oversee the logistics and distribution of medical cannabis.
In 2022, House Delegate and Chairman of the Judiciary Committee Luke Clippinger introduced a measure to put legalization on the general election ballot as HB1.
During the 2023 legislative session, the General Assembly passed legislation (House Bill 556 & Senate Bull 516) that established the framework for implementing legal adult-use sales and the various taxes and bureaucracy involved.
Upon the Governor’s signature on May 3, 2023, dispensaries were authorized to convert their existing licenses for dual medical and adult-use sales by July 1, 2023. This provided a seamless transition which isn’t always present in other states.
