Q. What are the qualifying conditions?

A: NY law states that you may be eligible for medical marijuana if you have been diagnosed with one or more of the following severe debilitating or life threatening conditions:

· Cancer

· HIV infection or AIDS

· amyotrophic lateral sclerosis (ALS)

· Parkinson’s disease

· multiple sclerosis

· spinal cord injury with spasticity

· epilepsy

· inflammatory bowel disease

· neuropathy

· Huntington’s disease

· post-traumatic stress disorder

· chronic pain (as defined by 10 NYCRR §1004.2(a)(8)(xi)), pain that degrades health and functional capability as an alternative to opioid use or substance use disorder

The severe debilitating or life-threatening condition must also be accompanied by one or more of the following associated or complicating conditions:

· cachexia or wasting syndrome

· severe or chronic pain

· severe nausea

· seizures

· severe or persistent muscle spasms

· PTSD

· opioid use disorder

 

Q. Will insurance cover the fees involved with the MMJ programs?

A: Unfortunately no. This is because cannabis is still illegal at a federal level.

 

Q. Can veterans obtain medical cannabis in New York?

A: Yes. Veterans can receive a medical cannabis card throughout the State of New York.

 

Q. Will patients registration status be made available to the public?

A: No, you are protected under HIPAA Laws.

 

Q. Am I allowed to grow medical cannabis in New York?

A: Unfortunately no, home cultivation is not currently allowed.

 

Q. What types of Medical Marijuana will be available?

A: The Commissioner must approve any form of medical marijuana. Approved forms include, but are not limited to:

· solid or semi-solid dosage forms (such as capsules, tablets, and lozenges)

· metered liquid or oil preparations (for vaporization or oral administration)

· metered ground plant preparations

· topicals and transdermal patches

Under the law, smoking is not permitted, and the regulations prohibit edibles.

 

Q. How much will I be able to own and purchase?

A: Patients may not exceed a 30-day supply as determined by their certifying practitioner.

A: The state keeps an active list of registered organization’s dispensing facilities here.

 

Q. How much is the fee to register in New York? 

A: The NY Department of Health is currently waiving the $50 fee for all patients and their designated caregivers.

 

Q. How long does it take to receive my MMJ card?

A: Applications with the state using a DMV ID are typically approved or denied immediately upon being submitted. Applications without a DMV ID can take up to 30 days to be approved. Once approved, physical ID cards are usually received within 7 business days.

 

Q. Are caregivers allowed?

A: Yes, a patient may designate up to 2 caregivers during the patient registration process. After the patient’s registration has been approved by the Department, the caregiver(s) must register with the Department. The patient will have access to instructions for caregiver registration. To register with the Department as a designated caregiver, you must be a resident of New York State and have a valid New York State Driver’s License or New York State Non-Driver ID card.
